Privacy Policy
Effective date: October 4, 2026
1. Who we are and what this policy covers
This Privacy Policy explains how RKM Investment Group LLC, a California limited liability company doing business as The Private Lender ('we,' 'us' or 'our'), collects, uses and shares information when you visit theprivatelender.net (the 'Site') or contact us about a loan. Our address is 27422 Portola Parkway, Suite 200, Foothill Ranch, CA 92610, and our phone number is (949) 368-9899.
The Site is for prospective borrowers and is not directed to investors. Our loan application portal at portal.theprivatelender.net runs on a third-party platform. Information you enter there is covered by this policy and by any notices and loan documents we give you. This policy does not cover other websites we link to. Use of the Site is also subject to our Terms of Use.
2. Information we collect
Information you give us. This includes your name, email address, phone number, property address and your message when you use a contact form, call or text us, or email us. If you apply through the portal, you may also provide the information needed to evaluate a business-purpose loan, such as details about you or your entity, the property, your experience, your financial position and supporting documents. That can include sensitive items such as Social Security numbers and bank or credit information. Please enter those only in the secure portal, never in a contact form or email.
Information from others. With your separate written authorization, we may obtain a credit report and other background or property information from consumer reporting agencies, title companies and public records.
Information collected automatically. When you visit the Site, we and our service providers may collect your IP address, browser and device type, pages viewed, referring page and the date and time of your visit, using cookies and similar technologies (see Section 5).
3. How we use information
We use information to:
- respond to your questions and requests;
- review, underwrite, close and service loan applications and loans;
- verify your identity and prevent fraud;
- contact you about your inquiry or application by phone, text and email, as described in our Terms of Use;
- operate, secure and improve the Site and our services;
- keep records and comply with laws, regulations and legal process; and
- enforce our agreements and protect our rights.
4. How we share information
We do not sell your personal information, and we do not share it with third parties for their own marketing. We share it only as follows:
- Service providers that help us run our business, such as the portal platform, website hosting, email and phone providers, e-signature, credit reporting, title and escrow companies, and our attorneys, accountants and insurers. They may use the information only to provide services to us.
- Loan participants. If we sell, assign, finance or service a loan, or arrange for a loan to be funded or documented with a partner, we may share the related information with the buyer, assignee, lender, servicer or partner and their advisors.
- Legal and safety reasons, such as to comply with law, respond to lawful requests, prevent fraud, or protect our rights, property or safety.
- Business transfers, if we merge with or sell part of our business, in which case the information may transfer to the new owner.
- With your consent or at your direction.
5. Cookies and analytics
The Site uses cookies and similar technologies to make pages work and remember preferences. We do not currently use Google Analytics or third-party advertising or tracking pixels on the Site. If that changes, we will update this policy. You can block or delete cookies in your browser settings, though parts of the Site may not work as intended. The Site does not currently respond to 'Do Not Track' signals, but we honor the Global Privacy Control signal where required by law.
6. Loan applications, credit reports and the portal
Our loans are for business purposes only, and we do not make loans to consumers for personal, family or household use. Information you submit about yourself in connection with a business-purpose loan may still include personal details, and we treat it as confidential. We request a credit report only after you give separate written authorization in the portal. We keep application information on the portal platform and in our own systems, and we use it as described in this policy. If any federal or state financial privacy law applies to a particular loan, we will give you the notice it requires.
7. Security and retention
We use reasonable administrative, technical and physical safeguards, including an encrypted connection and a secured portal with account login, to protect information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. Please do not send sensitive documents by email, text or a contact form.
We keep information for as long as needed to evaluate your inquiry or application, make and service any loan, and meet our legal, tax, accounting and record-keeping obligations. We then delete or de-identify it.
8. Your choices and rights
Marketing and texts. You can stop text messages at any time by replying STOP, and stop marketing emails by using the unsubscribe link or contacting us. We may still send messages about an application or loan you have with us.
Access, correction and deletion. You can ask us to tell you what personal information we hold about you, correct it, or delete it. We may keep information we are required or permitted by law to keep, such as loan records. To make a request, contact us as described in Section 9. We will verify your identity and respond within the time the law requires.
State privacy rights. Depending on where you live, you may have additional rights under state privacy laws, such as the right to know, access, correct, delete, or opt out of certain uses of your personal information, and to appeal a decision on your request. You will not be treated unfairly for using these rights. Some laws exempt information collected in connection with business-purpose lending or covered by financial privacy laws.
9. Children, changes, and contact
Children. The Site is intended for adults conducting business. We do not knowingly collect information from anyone under 18, and if we learn we have, we will delete it.
Changes. We may update this policy by posting the revised version on the Site with a new effective date.
